RESUMO:

Being established in 1582 and bringing together the desire in bear out the Christian faith, the Mosteiro de São Bento da Bahia (Saint Benedict Abbey of Bahia) was the very first Benedictine abbey built in America. Being present in the Bahian and Brazilian Society was quite important to the zone progress and to a strong identity development. Progenitor and protector of Bahian and Brazilian written history, it keeps in its library the Livros do Tombo do Mosteiro de São Bento da Bahia, officially recognised as Cultural Heritage by UNESCO, that tell us a lot about the ancient Salvador Society from they centennial pages. All texts are juridical from the books; therefore they have many Latin elements. The Latin, language of several Roman spheres, have been together to the Law during centuries. Roman law has been influencing all western world including Portugal where the law has multiple different sources. It is under the ancient Portuguese Law system that the Brazilian Colony will be ruled. The expected Latin elements present in the texts make their reading quite difficult somehow by untrained Latin readers. In the Philology area this master thesis purposes to deliver a free translation of these Latin elements from the Livro Velho do Tombo and the Livro III do Tombo along with a classification according to their linguistics feature: Latin terms in context; Latin free syntagmatic sequences; Latin phraseologism; Latin arguments. It discusses about the sources of Portuguese Law: The Roman Law, the Visigothic Law and the Canon Law of the Catholic Church, that become in a compilation, in Portugal, first named Ordenações Afonsinas, then Ordenações Manuelinas. Besides, discuss about the close relation between the Catholic Church, the Law and the Latin. This dissertation aims to make accessible the Latin content written in the documents from the Livros do Tombo to anybody who wants.
