SUMMARY:

Using the theoretical-methodological device of Materialist Discourse Analysis, this doctoral research has analyzed seven legislative proposals, in the form of an ordinary bill of law, at federal level, which deal with rights concerning LGBTQIAP+ social formation, whose Initiating House is the Chamber of Deputies. The general aim in this thesis is therefore to analyze the discursive processes that culminate in the configuration of the future, specifically the legal future, and then the elsewhere, as anchor points for the emergence of a legal subjectivity as a "new semantic", marked by the traversal of issues related to sexuality, notably homosexuality, and thus promoting a symbolic slide resulting from the desire for institutional legitimization of LGBTQIAP+ within the Legal Ideological State Apparatus, from the condition of abjection, materially becoming a subject of/for the Law. The thesis was formulated based on reflection on the triple real highlighted by Pêcheux, which is therefore a condition for the emergence of its organization. Thus, the thesis is structured by the introduction, followed by three sections which present the real of history, the real of language and the real of the subject as their ordering nucleus. As an effect of completeness, the thesis ends with the final considerations. It emerged, then, that the constitution of the legal subjectivity of LGBTQIAP+ subjects is permeated by a religious historicity, bringing out meanings that sometimes base the sayings materialized in the projects on Catholic-Christian ideological affiliations, in a relationship of alliance and sometimes of opposition. We also observed the mechanisms involved in the processing of the bills, configuring what we call "mechanical formulation", bringing to the intradiscourse the contradictory and conflicting positions of meaning resulting from the clash between dominant and dominated ideologies within the legislative-legal AIE. As far as the real of language is concerned, the emergence of a new lexicon as an instaurator of discursivities has opened the way for reflection on the clashes that affect language within the legal field. The traversals and silences materialized in the acronyms that denote the social formation in question were also the object of analysis in the thesis. As far as the real of the subject is concerned, the reflection revolved around the configuration of Law as a field of market exchanges, the need for textual materialization to legitimize subjectivities and the mark of a double incompleteness in the emergence of the subject - that of the ideological constitution, related to forgetfulness, and that of the subjective illusion that symbolizes the meanings elsewhere as significations of the subject's completeness. The configuration of the LGBTQIAP+ subject as a legal entity then becomes a position of resistance, in which the subject resists its historical, legislative, legal and political erasure. The discursive processes of their emergence are configured as movements of repetition and displacement, in which echoes of their existence are reverberated, grounded in a network of memory that also legitimizes the discourses made possible by the dominant ideological formation, while displacing the meanings that symbolize such subjects based on negation, also allocated in an interdiscursive zone that authorizes sayings about all subjects, about all humans. So, there was politics in the middle of the road. But there was resistance along the way.
