Philological edition and lexical study of a 19th century Bahian criminal process

The present study focuses on the laborious philological activity of editing texts, with the purpose not only of safeguarding handwritten documentation from the ravages of time, from improper handling, but also to contribute to philological and linguistic research in Brazil in general and, in Bahia in particular. In this perspective, the corpus selected for this thesis is a criminal process of physical aggression, practiced by José Torquato Ferreira in José Antonio da Hora, a manuscript document in 97 folios, written on the front and back, mostly drawn up between 1885 and 1886 in Vila de Santana do Catu in 19th century Brazil, which is in the judiciary collection ceded by the Wilton de Oliveira Desembargador Forum to the Federal Institute of Education, Science and Technology of Bahia (IFBAIANO), both based in Catu - BA. Thus, two major objectives are undertaken: the first, referring to the philological approach, or rather, based on the substantive, adjective and transcendent functions described by Spina (1977), focuses on fac-similar and semi-diplomatic editions of the Summary of guilt, articulating with other perspectives, such as Historiography, Codicology, Paleography, Diplomatics and Law, to place the document in the space-time in which it was developed, to understand how legal operators applied the current legislation and how aspects the intimate life of the procedural subjects involved (defendant and victim) reflect the Catuense society of the time (professional activity and level of education); the second, as a result of the philological operation, that is, of the semi-diplomatic edition, will establish a lexical study based on the assumptions of the methodology of the lexical fields of Eugênio Coseriu (1977) to evidence the vocabulary of crime present in the corpus, from the selected lexicons. To carry out the survey of lexicons related to the field of crime and the number of occurrences throughout the criminal process, the use of the computer tool AntConc (ANTHONY, 2016) stands out. As a theoretical contribution, in the philological field, scholars such as: Spina (1977), Cambraia (2005), Lose and Souza (2020), Borges and Souza (2012), among other references, are used. In the historiographical area, in order to contextualize the locus in which the judicial process took place, “the place of production” is located from the discussions of Barros (2020). The codicological aspects are anchored in Dias (2018), Rodríguez Díaz (2016), among others; paleographic aspects in Andrade (2010) and Ávila Seoane (2016) and diplomatic description in Belloto (2002) and Duranti (2015).
