SUMMARY:

In the constitution of the word and the counter-word, the interlocutors use several resources, among them: linguistic (de) courtesy. From their use, they seek to attend to their discursive projects. Thus, studying the word and the counter-word from the perspective of linguistic (de) courtesy constitutes understanding and verifying the importance of the strategies used by legal operators to convince the other that their argument is true. In addition, the reinterpretation of linguistic (de) courtesy under the axiological look of the word gives it a social and linguistic value. Therefore, investigating how the argumentative process of linguistic (de) courtesy takes place in the constitution of the authoritarian word and the counter-word in the votes of Ministers Joaquim Barbosa and Ricardo Lewandowski, in the Mensalão Judgment contributes to the construction of the speeches of these jurists, and also represents penetrating in a universe where the use by the speakers of the linguistic mechanisms gains the necessary strength to win the battles in the arena of the monthly allowance. To achieve this general objective, we will pursue the theoretical-methodological orientation of qualitative research, specifically, in the interpretative, documentary analysis and in the formation of the authoritarian and authoritative word based on linguistic (de) courtesy in the votes of Ministers Joaquim Barbosa and Ricardo Lewandowski, in the Mensalão Judgment Judgment. And we rely theoretically on: Bakhtin (2011, 2019) Cabral (2011); Ducrot (1987, 1994, 1981); Fávero (2014); Perelman and Olbrechts-Tyteca (2005), Volóchinov (2018, 2019) among others. As it is a research in its initial phase, we do not yet have the results, however, we believe that the historical and social values that the word carries belong to the space of argument in the legal environment. When defending or accusing a defendant, the lawyer or prosecutor chooses words that represent a subject, that is, the description made by the defender or accuser in relation to the defendant leaves the linguistic plane for the discursive.
